NA STANDING COMMITTEE ON CABINET SECRETARIAT RECOMMENDS LEGISLATION FOR ESTABLISHING AUTHORITY TO MANAGE FEDERAL GOVERNMENT REAL ESTATE

 

UNDERSCORES NEED FOR PRUDENT UTILISATION OF GOVERMENT PROPOERTIES FOR OPTIMUM ECONOMIC BENEFIT

 

Islamabad; June 2, 2026. The Standing Committee on Cabinet Secretariat in its meeting held today recommended establishment of an Authority to manage federal government real estate. The Committee underscored the prudent utilisation of government real estate for generating optimum economic return.The Committee met under the chairmanship of Malik Ibrar Ahmad, in Parliament House, today. 

The Committee after indept discussion, unanimously recommended the proposed legislation without amendments for passage by the Assembly.

 

During the course of discussion, Chairman Malik Ibrar Ahmad opined that various government properties personally known to him had been encroached. Quoting th instance of encroachment of Railway land, he said that he raised the issue in meeting of the Standing Committee on Railways as Member and the encroachers were evicted on th directions of the Committee. He said that these lands have gained in value over time due to expansion of urban areas and growth of commercial activities, however, most of government, entities were not been able to manage these real estate optimally. He supported the establishment of th Authority.

 

The Secretary Cabinet Division apprised the Committee that the Federal Government owned a vast tract of commercial urban and rural immovable property throughout the length and breadth of the country including land and structures built thereon were owned, operated and managed by the Federal Ministries, Divisions and organizations under their control, however despite government directions, most of the government real estate were not being utilized in an economically viable manner and were also subjected to encroachment.

He further said that these properties had been overwhelmed with multiple problems like encroachments, illegal occupation, etc. He further added that several attempts in the past had been made to make use of some of the properties for generating optimum economic returns, nevertheless they went in vain. 

 

He said that managing real estate, especially land, was a specialized function and none of the existing government organizations have the exclusive mandate and capacity to perform this function in a manner where these properties generate valuable returns for the economy. He further added that such functions were required to be performed by a dedicated professional agency / organization. He said that the proposed a new organization namely Federal Government Real Estate Management Authority would be established to own, mange or lease properties of the Federal Government as approved by the Federal Government.

 

The Committee discussed and recommended "The Archival Material (Preservation and Export Control) (Amendment) Bill, 2026" with an amendment in section 2(a) of the replacing words "Secretary of the concerned Division" with the words "The Prime Minister". The Committee was of the view that the authority to constitute Advisory committee for deciding the course of action adopted for preservation of archival material should rest with the Prime Minister. 

 

The Committee unanimously recommendes the Abandoned Properties (Management) (Amendment) Bill, 2026 and the Oil and Gas Regulatory Authority (Amendment) Bill, 2026 without amendments for passage by the Assembly. 

 

The Secretary Cabinet Division apprised the Committee about the objects and reasons of the aforementioned bills. He said that the amendments have been moved in the substantiative laws to align them with a view to streamlining governance, improving administrative efficiency, and ensuring that the Federal Cabinet focuses on matters of national policy and strategic importance. He further apprised that the Cabinet Division, in pursuance of the direction of the Federal Cabinet, had undertaken a comprehensive review of relevant laws and had prepared the amendment bills to rationalize and reassign such powers to the appropriate authorities. He also informed the Committee that Federal Cabinet had decided this in consequence to the judgment of the Honourable Supreme Court of Pakistan in the Mustafa Impex, Karachi v. Government of Pakistan.

 

The meeting was attended by MNAs. Ms. Tahira Aurangzeb, Ms. Farah Naz Akbar, Dr. Ramesh Kumar Vankwani, Ms. Rana Ansar, Ms. Shahida Begum, Mr. Ehsan-ul-Haq Bajwa, through zoom, Secretary Cabinet Division and other officers of the concerned departments.

اسلام آباد؛ 2 جون 2026۔ قومی اسمبلی کی قائمہ کمیٹی برائے کابینہ سیکرٹریٹ کا اجلاس چیئرمین کمیٹی ملک ابرار احمد کی صدارت میں آج پارلیمنٹ ہاؤس اسلام آباد میں منعقد ہوا۔ اجلاس میں کمیٹی نے وفاقی حکومت کی جائیداد کے انتظام کے لیے ایک اتھارٹی کے قیام کی سفارش کی۔ کمیٹی نے حکومتی املاک کے شفاف اور دانشمندانہ استعمال پر زور دیا تاکہ زیادہ سے زیادہ معاشی فوائد حاصل کیے جا سکیں۔کمیٹی نے تفصیلی بحث کے بعد متفقہ طور پر مجوزہ قانون کو بغیر کسی ترمیم کے اسمبلی سے منظور کروانے کی سفارش کی۔

 

بحث کے دوران چیئرمین کمیٹی ملک ابرار احمد نے کہا کہ ان کے ذاتی علم میں ہے کہ کئی سرکاری املاک قبضہ مافیہ کے قبضہ میں ہیں۔ انہوں نے ریلوے کی زمین پر قبضے کی مثال دیتے ہوئے کہا کہ بطور ممبر انہوں نے ریلوے سے متعلق قائمہ کمیٹی کے اجلاس میں یہ مسئلہ اٹھایا تھا جس پر کمیٹی کی ہدایت پر قابضین کو بے دخل کر دیا گیا تھا۔ انہوں نے کہا کہ شہری علاقوں کی توسیع اور تجارتی سرگرمیوں کے فروغ کی وجہ سے ان زمینوں کی قدر میں وقت کے ساتھ اضافہ ہوا ہے، تاہم زیادہ تر سرکاری ادارے ان جائیدادوں کا بہتر انتظام نہیں کر پا رہے۔ انہوں نے اتھارٹی کے قیام کی حمایت کی۔

 

سیکرٹری کابینہ ڈویژن نے کمیٹی کو آگاہ کیا کہ وفاقی حکومت ملک بھر میں وسیع رقبے پر مشتمل تجارتی، شہری اور دیہی غیر منقولہ جائیداد کی مالک ہے جس میں زمین اور اس پر تعمیر شدہ عمارتیں شامل ہیں۔ یہ جائیدادیں وفاقی وزارتوں، ڈویژنز اور ان کے زیرِ انتظام تنظیموں کی ملکیت، استعمال اور انتظام میں ہیں۔ تاہم حکومتی ہدایات کے باوجود زیادہ تر سرکاری املاک معاشی طور پر منافع بخش طریقے سے استعمال نہیں ہو رہیں اور وہ تجاوزات کا شکار بھی ہیں۔

 

انہوں نے مزید کہا کہ ان جائیدادوں کو تجاوزات، غیر قانونی قبضے وغیرہ جیسے متعدد مسائل درپیش ہیں۔ انہوں نے کہا کہ ماضی میں کئی بار ان میں سے کچھ جائیدادوں کو زیادہ سے زیادہ معاشی منفعت کے لیے استعمال کرنے کی کوشیں کی گئیں، لیکن وہ ناکام رہیں۔

 

ان کا مزید کہنا تھا کہ جائیداد، بالخصوص زمین، کا انتظام ایک مخصوص مہارت کا تقاضا کرتا ہے اور موجودہ سرکاری اداروں میں سے کسی کے پاس بھی یہ خصوصی  استعداد موجود نہیں کہ وہ ان جائیدادوں سے معیشت کے لیے قیمتی منفعت پیدا کر سکیں۔ انہوں نے کہا کہ یہ کام ایک مخصوص پیشہ ورانہ ایجنسی/تنظیم کے ذریعے انجام دیا جانا چاہیے۔ انہوں نے بتایا کہ تجویز ہے کہ وفاقی حکومت کی منظوری سے "وفاقی حکومت جائیداد انتظامی اتھارٹی" کے نام سے ایک نیا ادارہ قائم کیا جائے گا جو وفاقی حکومت کی جائیدادوں کو سنبھالے اور لیز پر دے۔

 

کمیٹی نے "آرکائیول میٹریل (تحفظ اور برآمد پر کنٹرول) (ترمیمی) بل 2026" پر بحث کی اور اس کی دفعہ 2(اے) میں "متعلقہ ڈویژن کے سیکرٹری" کے الفاظ کی جگہ "وزیرِ اعظم" کے الفاظ شامل کرنے کی ترمیم کے ساتھ سفارش کی۔ کمیٹی کی رائے تھی کہ آرکائیول مواد کے تحفظ کے لیے اختیار کی جانے والی حکمتِ عملی طے کرنے والی مشاورتی کمیٹی کے قیام کا اختیار وزیرِ اعظم کے پاس ہونا چاہیے۔

 

کمیٹی نے متفقہ طور پر "ترک شدہ جائیدادیں (انتظام) (ترمیمی) بل 2026" اور "آئل اینڈ گیس ریگولیٹری اتھارٹی (ترمیمی) بل 2026" کو بغیر کسی ترمیم کے اسمبلی سے منظور کروانے کی سفارش کی۔

 

سیکریٹری کابینہ ڈویژن نے کمیٹی کو مذکورہ بالا بلوں کے اغراض و مقاصد سے آگاہ کیا۔ انہوں نے کہا کہ بنیادی قوانین میں یہ ترامیم حکومت کو بہتر بنانے، انتظامی کارکردگی بہتر بنانے اور اس بات کو یقینی بنانے کے لیے لائی گئی ہیں کہ وفاقی کابینہ قومی پالیسی اور اسٹریٹجک اہمیت کے معاملات پر توجہ دے۔ انہوں نے مزید بتایا کہ وفاقی کابینہ کی ہدایت پر کابینہ ڈویژن نے متعلقہ قوانین کا جامع جائزہ لیا ہے اور اختیارات کو مناسب حکام کو منتقل کرنے کے لیے یہ ترمیمی بل تیار کیا ہے۔ انہوں نے کمیٹی کو یہ بھی مطلع کیا کہ وفاقی کابینہ نے یہ فیصلہ معزز سپریم کورٹ آف پاکستان کے "مصطفیٰ امپیکس بمقابلہ حکومت پاکستان" کیس کے فیصلے کے نتیجے میں کیا ہے۔
