RESOLUTION NO. 12
CONSENSUS RESOLUTION PASS AT THE CONCLUSION OF THE IN-CAMERA JOINT SITTING OF PARLIAMENT
(8TH OCT-22 OCT 2008)
This in-camera joint session of Parliament has noted with great concern that extremism, militancy and terrorism in all forms and manifestations pose a grave danger to the stability and integrity of the nation-state. It was recalled that in the past the dictatorial regimes pursued policies aimed at perpetuating their own power at the cost of national interest.
This House, having considered the issue thoroughly and at great length is of the view that in terms of framing laws, building institutions; protecting our citizens from violence, eradication of terror at its roots, re-building our economy and developing opportunities for the disadvantaged, we all commit to the following:-
1. That we need an urgent review of our national security strategy and revisit the methodology of combating terrorism in order to restore peace and stability to Pakistan and the region through an independent foreign policy.
2. The challenge of militancy and extremism must be met through developing a consensus and dialogue with all genuine stakeholders.
3. The nation stands united to combat this growing menace, with a strong public message condemning all forms and manifestations of terrorism, including the spread of sectarian hatred and violence, with a firm resolve to combat it and to address its root causes.
4. That Pakistan’s sovereignty and territorial integrity shall be safeguarded. The nation stands united against any incursions and invasions of the homeland, and calls upon the government to deal with it effectively.
5. That Pakistan’s territory shall not be used for any kind of attacks on other countries and all foreign fighters, if found, shall be expelled from our soil.
6. That dialogue must now be the highest priority, as a principal instrument of conflict management and resolution. Dialogue will be encouraged with all those elements willing to abide by the Constitution of Pakistan and rule of law.
7. That the development of troubled zones, particularly the tribal areas, and NWFP (Pukhtoonkhwa), must also be pursued through all possible ways and legitimate means to create genuine stakeholders in peace. New economic opportunities shall be created in order to bring the less privileged areas at par with the rest of Pakistan.
8. That a political dialogue with the people of Balochistan, the redressal of grievances and redistribution of resources shall be enhanced and accelerated.
9. That the state shall maintain the rule of law, and that when it has to intervene to protect the lives of its citizens, caution must be exercised to avoid casualties of non-combatants in conflict zones.
10. That the federation must be strengthened through the process of democratic pluralism, social justice, religious values and tolerance, and equitable resource sharing between the provinces as enshrined in the Constitution of 1973.
11. That the state shall establish its writ in the troubled zones, and confidence building mechanisms by using customary and local communities (jirga) and that the military will be replaced as early as possible by civilian law enforcement agencies with enhanced capacity and a sustainable political system achieved through a consultative process.
12. That Pakistan’s strategic interests be protected by developing stakes in regional peace and trade, both on the western and eastern borders.
13. That mechanisms for internal security be institutionalized by; paying compensation for victims of violence; and rehabilitate those displaced from their homes as soon as possible; that spill-over effects of terrorism be contained throughout the country and that public consensus be built against terrorism through media and religious participation.
14. That a Special Committee of Parliament be constituted to periodically review, provide guidelines and monitor the implementation of the principles framed and roadmap given in this Resolution. This House authorizes the Speaker to constitute the said Committee in consultation with the parliamentary leaders of both Houses. The Committee will frame its own rules upon meeting.

RESOLUTION NO. 11

Resolution by the National Assembly on Coalition/ISAF Attack in village Zulahi near Angoor Adda
We, members of the National Assembly of Pakistan, by this resolution, strongly condemn the attack by Coalition/ISAF troops on village Zulahi near Angoor Adda on 3 September 2008.
The attack has resulted in loss of precious lives including women and children.
The Chinook helicopter borne ground attack supported by additional air assets based in Afghanistan is a gross violation of Pakistan’s sovereignty and territorial integrity.
It also undermines the basic norms of international law and contradicts simply the very basis of cooperation between Pakistani security forces and ISAF/Coalition forces in Afghanistan.
Any incursion inside our territory and resulting loss of innocent lives is unacceptable. This matter may be taken up strongly with member countries of the ISAF.
This House calls upon the Government of Pakistan to take all necessary measures to protect the sovereignty and territorial integrity of the country and repel such attacks in the future with full force.
This House expresses its full solidarity and complete sympathy with the people of FATA who are equal citizens and continue to bear the burnt of terrorism in all its forms and manifestations.
The National Assembly demands that the government immediately arrange compensation for the victims and their families affected by this wanton and most gruesome act.
We resolve to discuss the situation arising from the condemnable attack on Pakistan’s territory by militants/terrorists and foreign forces and for this purpose convene a Special Session.
The National Assembly also reiterates the resolve of the people of Pakistan to combat all forms and manifestation of terrorism.

The National Assembly of Pakistan
Having been hurt over the publication of imaginary caricatures and pictures of Prophet Muhammad (PBUH) and his companions (Sahaba) in an Indian newspaper strongly condemns the blasphemous act on the part of the newspaper, “The Hindustan Times” and demands the Federal Government to-
· Lodge strong protest with the Indian Government;
· Summon Indian High Commissioner in the Foreign Office to convey to him the utmost resentment and sentiments of the Muslims in Pakistan;
· Demand strict action against the newspaper in accordance with law to prevent publication of such like matter in future.

The National Assembly of Pakistan hereby resolves that:
· Deeply concerned at the arrest and detention of Pakistani national Dr. Aafia Siddiqui;
· Anguished at the media reports of serious health condition of Dr. Aafia Siddiqui;
· Concerned about the lack of information about the under-aged children of Dr. Aafia Siddiqui;
· Taking note that consular access has been provided to the Pakistan embassy officials;
· Recalling the obligations of states consistent with the International Law and Universal Declaration of Human Rights including International Conventions;
· Now, therefore, hereby, call upon the Federal Government to take up the matter with the US authorities to-
Ø Urgently provide necessary medical assistance including hospitalization, if required, to Dr. Aafia Siddiqui;
Ø make provision of a female doctor for her medical examination and treatment;
Ø give full respect to Dr. Aafia Siddiqui’s religious beliefs;
Ø provide regular consular access to Embassy officials as well as for regular family visits to Dr. Aafia Siddiqui;
Ø give immediate information on the whereabouts of her children and their immediate custody to the members of the family or the Pakistani authorities;
Ø demand immediate repatriation of Dr. Aafia Siddiqui to Pakistan.

RESOLUTION NO. 8

The National Assembly of Pakistan notes with regret the continuing use of excessive force by the Indian Security Forces in the Indian Occupied Jammu and Kashmir which has left to the loss of precious lives and civil unrest. We note with deep grief the recent myrtadom of Sh. Abdul Aziz, the prominent Huriayyat leader at the hands of Indian Security Forces and we are concerned over the tension and fear that has gripped the entire Muslim population of Indian occupied Kashmir, arising out of attack by the security forces on Muslim and their properties and the continuing economic blockade of the valley. To this effect, the National Assembly of Pakistan expresses deep condolences over the shahadat of Sheikh Abdul Aziz and several other Kashmiris by the Indian Security Forces. We condemn the excessive and brutal use of force by the Indian Security Forces against the innocent civilian population of Indian occupied Kashmir and we call for immediate steps to address the situation and put an end to the unwarranted use of force and gross human rights violations being committed against the innocent Kashmiris. This resolution and this Assembly reaffirms the political and moral and diplomatic support of the people and the Government of Pakistan to the Kashmiri people in their struggle to achieve their right including the right to self determination.
We also call for an early, just, durable and peaceful settlement of the Jammu and Kashmir dispute in accordance with relevant United Nations resolutions and aspirations of the Kashmiri people.
Finally, we call upon the international community, in particular the United Nations and human rights organizations to take note of the deteriorating situation in Indian occupied Kashmir and use their good offices to urge India to stop the atrocities against unarmed civilian Kashmiries.

Government Resolution
“This House strongly condemns the printing and re-printing of the sacrilegious and blasphemous caricatures of the Holy Prophet of Islam and the release of an offensive and derogatory documentary on Islam entitled “Fitna” by the Dutch Parliamentarian Geert Wilder.
The House firmly believes that these acts of defamation and incitement to hatred not only deeply hurt the sentiments of Muslims all over the world but also threaten the stability of many societies and as such are in violation of international law including the UN Charter, as well as the domestic laws of the countries where these sacrilegious acts are carried out.
The House takes note of the strong protest lodged with the respective governments by the Government of Pakistan as well as other Muslim countries individually or collectively in the OIC framework in this regard. The Governments of the Netherlands and Denmark have been asked to prosecute the responsible people for defaming other religions under their own laws. They were told that right to freedom of expression does not give licence to offend members of the religions and that these sacrilegious acts went against the efforts of those countries and individuals who are building bridges between religions and civilizations.
The House calls on the UN to take all necessary legal, political and administrative steps to curb this trend and ensure the respect for all religions in these societies. In this context, the House takes note of the recently adopted resolution on the mandate of Special Rapporteur of the UN Human Rights Council on freedom of expression which has mandated the Rapporteur to report on instance where abuse or the right of freedom of expression constitute the act of religious discrimination. The House hopes that the UN would take further legal action to fill the gap in the existing legal regimes in relation of defamation of religions and incitement of hatred.

“This House mourns the tragic assassination of Shaheed Mohtarma Benazir Bhutto resulting in colossal loss to the people of Pakistan as well as the World. This House recommends that the Government should approach the United Nations to get the tragic assassination of Shaheed Mohtarma Benazir Bhutto probed by forming an International Investigation Commission to be known as “Shaheed Mohtarma Benazir Bhutto Commission” to identify the culprits, perpetrators, organizers and financiers behind this heinous crime and bring them to justice.”
